[4] 14 - Bribery
Confers, or agrees to confer, any benefit upon a public servant upon an agreement or understanding that such public servant's vote, opinion, judgement, action, decision or exercise of discretion as a public servant will thereby be influenced.
This offence is a wobbler charge. This means that it may be either a Federal Charge or a Regular Charge depending on whether the person being, or attempting to be bribed, was a federal official or a regular government official.
Felony Sentence: 400 Seconds Fine: $1,000
Note:
Bribery becomes a crime in several ways, it can either be Bribery of executive officers or public servants such as law enforcement officers, pubic employees, district attorneys or coroner offices.
Defense:
1) Lack of corrupt intent 2) Entrapment or coercion 3) Intoxication
