[7] 15 - Urination or Defecation in Public

  • It is illegal for any person to urinate or defecate on any public property including: streets, highways, sidewalks, parking lots, or other public areas and structures such as fountains, road verges, alleyways, etc..

  • It is illegal for any person to urinate or defecate on any private property while in plain view of the public.

    • For example: No person may urinate on their driveway while in plain view of passing pedestrians and vehicles.

  • It is illegal for any unauthorized person to urinate or defecate on any private property which is not theirs, even if hidden-from-view, except when using a restroom.

  • It shall be permitted for persons to urinate or defecate on public lands so long as it:

    • Is out of public view.

    • Is not a Beach or Municipal Park.

    • Is in an area of nature; including woody vegetation, shrubbery, or bushes.

    • For example: A person may urinate or defecate out of public view in the shrubbed-area to the side of a rural highway. A person may urinate or defecate out of public view in the brush of a hiking trial or forest/camp area.

Sentence: 5 (The booking / jailing of this crime is optional and left to the discretion of the arresting officer) Fine: $500
