[8] 3 - Brandishing a Firearm or Deadly Weapon

Drawing or exhibiting a deadly weapon or firearm in a public area.

Drawing or exhibiting a deadly weapon or firearm on private property in a manner which is threatening, instigatory, or shows an intent to use illegally.

Felony Sentence: 250 Seconds Fine: $1000

The term "Firearm" does not include an antique firearm or a clearly identifiable imitation weapon with an orange muzzle tip.

Examples:

1) Jerome is in a fight with his neighbor and hits him in the head with the grip of his handgun. 2) Eddie lifts his shirt to reveal the pistol in his waistband. 3) Albert makes verbal threats while gesturing a knife in his hand. 4) Jonathan un-holsters his firearm and points it at someone during a verbal argument.
